Just found this as I was heading out the door: The Freedom of Imagination: Copyright’s Constitutionality by Jed Rubenfeld in the Yale Law Journal. The abstract (all I’ve had time for - I have to pick up someone!) suggests a new construction for copyright that would limit those pesky First Amendment issues that keep coming up.
